Pop-Up Form Monthly Drawing -OFFICIAL RULES

NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

This Monthly Drawing consists of a monthly sweepstakes drawing that awards one monthly winner a $100.00 gift card for use at the Seacoast EBikes store at 109 Gosling RD in Newington NH. The gift card is only valid for in store purchases.

SPONSOR: The Monthly Drawing is sponsored and administered by Seacoast E-Bikes.

MONTHLY DRAWING PERIOD: The Monthly Drawing started at 12:00 a.m. EST on March 1st, 2023, and will continue until 11:59 p.m. EST on the last day of the month in which Sponsor terminates the Monthly Drawing (“Monthly Drawing Period”).

HOW TO ENTER: Go to www.seacoastebikes.com and complete the online pop-up form. To be included in the monthly drawing, entrant must complete the Online Pop-up Form in its entirety, including his/her full name, phone number and/or email address to receive any prize. All entrants who complete the pop-up form will automatically be entered in the prize drawing for the month of entry. Online registration must be received and recorded by Seacoast EBikes by 11:59 p.m. EST on the last day in each month of the Monthly Drawing Period to be eligible for that month’s drawing. Entry is limited to one entry per email address.

SELECTION OF WINNERS: Within 8 days after the end of each month during the Monthly Drawing Period, one (1) monthly winner will be randomly selected from among all eligible entries received during the previous month. Sponsor’s decisions are final and binding in all matters relating to selection of Monthly Drawing winners. Non-winning entries will NOT be rolled over into subsequent monthly drawings. Winner must first sign an affidavit, to be administered by e-mail, and his/her entry must be verified by Sponsor. Sponsor reserves the right to require proof of age and state of residence prior to awarding any prize.

PRIZES: One (1) prize in the form of a $100.00 Seacoast E-Bikes gift card will be awarded each month to the entry selected in a random drawing from among all eligible entries. The prize can be picked up by the winner at the store during open hours.

WINNER NOTIFICATION: Winner(s) will be notified by email within 48 hours of the drawing. Sponsor may also announce winners through Sponsor’s social media channels or website using the winner’s first name and last initial, city and state. Winners will be required to acknowledge by email within ten (10) business days of the date on which it is sent to them. If the acknowledgement is not received by Sponsor within ten (10) business days of notification at the address specified in the notification, the prize will be forfeited and an alternate winner may be selected in a random drawing from the remaining eligible entries for the month. If any potential winner is found to be ineligible, or has not complied with these Official Rules or declines the prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.

The Seacoast EBikes gift card may be redeemed at our store located at 109 Gosling Rd in Newington NH. Gift cards can only be used for purchases at our Newington store and may not be used for online purchases. No cash will be given for any unused portion of a gift card.

All prizes are non-transferable and non-assignable. No cash alternative or substitution of prize(s) is permitted except by Sponsor. Sponsor will make every reasonable effort to award all prizes. The odds of winning are dependent upon the number of eligible entries received each month.

CONDITIONS: By submitting an entry, entrant agrees to the terms of these Official Rules and consents to the use of the entrant’s name and other information by Monthly Drawing Entities for purposes of e-mail, direct mail or other marketing and solicitation purposes. Sponsor is not responsible for lost, late, damaged, illegible, stolen, misdirected, misidentified, postage due or incomplete entries, regardless of the cause. Entries become the property of Sponsor and will not be returned. Sponsor is not responsible for any costs associated with claiming any prize. Winners are solely responsible for the reporting and payment of all taxes, if any, that may result from claiming a prize in this Monthly Drawing. Entries in any way tampered with, forged, mutilated, incomplete, illegible, photocopied or mechanically reproduced, or submitted by or through fraudulent means may be disqualified in the sole discretion of Sponsor. This includes any entry that does not comply with these Official Rules in any respect. Decisions of Sponsor are final on all matters of fact, interpretation, eligibility, procedure, selection of winners, award of prizes, and fulfillment in respect to this Monthly Drawing. Sponsor reserves the right at any time to suspend, modify or terminate this Monthly Drawing or to modify, amend, or supplement these Official Rules in its sole discretion, subject to applicable law.

Winners consent to the use by Sponsor or other Monthly Drawing Entities of their name, city, and state for any lawful purpose, without further permission or compensation, except where prohibited by law. If used for digital or traditional marketing purposes, winners will only be identified by first name and initial of last name. Winners agree to abide by and be bound by the terms and conditions of these Official Rules.

Sponsor reserves the right, in its discretion, to suspend or cancel this Monthly Drawing at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of this Monthly Drawing. Sponsor also reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the website, or who is otherwise in violation of these Official Rules. Any attempt to damage the pop-up form site or undermine the legitimate operation of the Monthly Drawing is a violation of criminal and civil laws. Should such an attempt be made, Monthly Drawing Entities reserve the right to prosecute violators to the fullest extent allowable by law.

RELEASE AND LIMITATION OF LIABILITY: By participating in the Monthly Drawing, each entrant agrees to release and hold harmless Sponsor and all other Monthly Drawing Entities from any and all losses, damages, rights, claims and actions of any kind in connection with this Monthly Drawing or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

Except where prohibited, participants agree that (1) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred in participation but in no event attorney’s fees; and (2) under no circumstances will a participant be entitled to obtain awards for and participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased.
 
GENERAL: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and the decisions of the Monthly Drawing Entities in connection with the Monthly Drawing shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard for conflict of laws doctrine. Should any term or provision of these Official Rules be determined to be void, unenforceable or contrary to applicable law as provided herein, such term or provision shall be deemed to be severed from the other terms and conditions to the extent necessary to bring the term or provision within the requirements of such law, and the remainder of these Official Rules shall be given effect as if they had not included the severed item.
 
LIMIT: A completed form results in the entrant being eligible to win that month’s contest. Multiple entries are not permitted by an entrant even if the entrant uses different email addresses or completes the survey more than once. Any attempt to use different or multiple email addresses or other methods to make multiple entries will void all entries submitted by the entrant. Use of any automated system to participate in the Monthly Drawing is prohibited and will result in voiding of all entries and disqualification of the entrant. Individuals who win a prize in a monthly contest and any “member of the winner’s household” will not be eligible to participate in subsequent monthly contests of the Monthly Drawing. Any participant who resides at the same address as the winning participant are deemed a “member of the winner’s household” for purposes of determining eligibility to participate in the Monthly Drawing.
